Bombay High Court goes the SC way, refuses stay in Jiah Khan trial

In the latest development in the Jiah Khan case, a bench of the Bombay High Court refused to grant a stay, stating that it was in ‘no mood’ for one. This comes in just two days after the apex Court refused to grant stay in the trial against her ex-boyfriend, Bollywood actor Sooraj Pancholi.

The bench further gave instructions to Rabia Khan, Jiah’s mother, to approach another bench with her insistent plea and a fresh round of investigations in her death.

Rabia, through her advocate, Subhash Jha, had sought for a stay on the proceedings from a bench comprised of judges Justice Abhay Gadkari and Justice MS Karnik, on the grounds that the trial court was showing “unnecessary haste” in hearing the case.

Jiah Khan’s mother, Rabia, wants the murder charge to be invoked against actor Sooraj Pancholi. Sooraj had been then arrested by the CBI under the context of him abetting to her suicide, but Rabia has asked that he be framed with the charges of her daughter’s murder.

On June 3, 2013, actress Jiah Khan had been found dead at her Juhu flat. Sooraj Pancholi, her former boyfriend, was arrested subsequently on the charges of abetting her to suicide, but was released on bail.

In October, the same year, Rabia had expressed her strong desires for the case to be investigated in detail by the FBI, owing to the fact that her daughter had a US citizenship. On May 5, Rabia asked the trial court to frame charges against Sooraj for the actress’ murder and rape, and forced abortion.
